Not Just Sea Turtles, Let’s Protect Women Too: Invoking Public Morality Exception or Negotiating New Gender Exception in Trade

The most common provisions we find in almost all multilateral, regional and bilateral trade agreements are the exception clauses that allow countries to protect public morals, humans, animals or plant health and life, and conserve exhaustible natural resources. If countries can allow trade-restrictive measures that aim to protect these non-economic interests, is it possible to negotiate a specific exception to justify measures that are aimed at protecting women’s economic interests as well?

World Trade Law, at Stockholm University

The course, taught to LLM students at Stocholm University, focused on the laws, principles and jurisprudence of World Trade Law. Students were taught the basic principles of multilateral trade and were encouraged to engage with the practice of international trade law with the help of current jurisprudence and hypothetical dispute scenarios. The students recieved an appreciation of the purpose and functions of the WTO and be familiar with its principal rules, impact and jurisprudence.

This project is aimed at improving the understanding of why mainstreaming gender equality considerations in the trade policy context is of crucial importance. The expected outputs, a comprehensive volume on the subject as well as a dedicated special issue in the Latin American Journal of Trade Policy, will address the different approaches and experiences of countries in this respect, the impediments that restrict progress, and the road ahead to achieve a more inclusive trading environment and regulatory framework.
