National Social Science Fund of China: Research on the Legal Issues of China's Overseas Port Investment Operation under the "Belt and Road"
Date of Project: June/2017 to June/2020
Nowadays, the launch of the initiative of the "Belt and Road" has spurred a massive investment in overseas ports funded by Chinese companies. In recent years, Chinese companies have announced the participation in more than 40 overseas port investment operations, especially in the countries or regions along the "Belt and Road". Meanwhile, the sector of port is closely associated and linked to the absolute sovereignty of the home country. As a result, the investment in overseas ports may involve more risks and raise some particular legal issues, compared to the investment operations in other projects. Thereby, it is necessary to do research on this topic, and focus on the legal issue related to China's overseas port investment operation. The research would be based on a number of law subjects, such as the international law on foreign investment, the competition law, the maritime law, the port law, and some other relevant regulations. The main objective of this research is to assess and decrease the investment risks, which have been taken by the Chinese companies, and to provide the best legal advice which would be appropriate to the needs of investment companies, local governments and relevant organizations.
