International Economic Law for Post-Covid Latin America: An Agenda for Recovery
This article examines Latin America's post-Covid challenges, highlighting social unrest and economic pressures. It explores the intellectual backing of structuralism—a regionally distinct approach to development—that informs contemporary reform efforts. The discussion then shifts to international trade law, considering how its flexibilities regarding subsidies and state enterprises might support a transformative economic agenda. Additionally, it addresses the democratic risks associated with interventionist policies and suggests that a unique form of constitutionalism could serve as a safeguard against authoritarianism. Finally, the analysis considers how great power competition between China and the U.S. may constrain Latin America's ability to implement its progressive trade strategies.
