The Intellectual Property clauses of the FTA Agreements has reflected the conflicts among the developed countries and developing countries due to their different economic and technological phases. However, high standard of the international intellectual property protection is an inevitable trends. Since the intellectual property institution and its notion origins from the western countries, China has been adjusting to it passively for years, and has been lack of the negotiation experience and skill which hinders China from creating its own model in the FTA IP chapters. To regulate the IP chapter in China’s FTA negotiations, it is necessary to structure the IP strategy in China’s FTA. The IP strategy should be studied as a whole, consisting of the mutual relations as well as the regularity of the changes among IP strategy system, the internal and external influential factors of the FTA and the IP regulations.
